OPTFA’s Follow-up Response Sent on July 23, 2013:
The link you provided does not satisfy this request. Provide documents as originally requested.

Response: There is no record responsive to this request.  Requests for information, or requests that require the records custodian to create a new record by searching for and compiling information are improper requests under R.C. 149.43. The university has no duty to create a new record for the purpose of responding to a public records request. State ex rel. Morgan v. New Lexington, 2006-Ohio-6365, 112 Ohio St. 3d 33, 38, 857 N.E.2d 1208, 1215.

OPTFA’s Follow-up Response Sent on Sept. 25, 2013:
We have made this request of other public institutions in Ohio and have received the documents we requested in full, without argument. It would be irresponsible for your institution to fail to collect contact information for part-time faculty and to have that information on file. These records should be available through HR and should be readily available by sorting an Excel spreadsheet. Please provide.

Response:Please see attached for Fiscal Years ending 2003 through 2009. (OPTFA has these budgets, but they have not been uploaded to the website yet.)  2010 through 2013 can be found on our website at http://www.kent.edu/budgetoffice/index.cfm.

Response: We are currently identifying and gathering these records, if they exist, and will provide you with an update shortly.

4. Spreadsheet of current university staff who hold faculty, staff, administrative, management or executive positions, sorted by salary
Response: Please see attached record responsive to your request.

5. Position descriptions of top 50 staff by salary identified in #4
Response: There is no record responsive to this request.  Requests for information, or requests that require the records custodian to create a new record by searching for and compiling information are improper requests under R.C. 149.43. Universities are required to have position descriptions for all employees. Please refer to the spreadsheet provided in number 4 and provide us with the position descriptions of those employees. This request does not require you to create newrecords. However, it does require you to comply with Ohio law and provide us with records that already exist.

Requests for information, or requests that require the records custodian to create a new record by searching for and compiling information are improper requests under R.C. 149.43. Response: There are no records responsive at this time for the Fall 2013 semester. After our Sept. 25, 2013, follow-up request, Kent State sent an additional response, providing a List of Part-Time Faculty for Fall Term 2013. It includes names, title, salary, department, college and campus, but it does not include the number of credit hours the part-time faculty member is teaching during fall term 2013.

3. Contracts for adjunct/contingent/part-time faculty for fall semester 2013
Response: There are no records responsive at this time for the Fall 2013 semester.

4. Performance evaluations for all adjunct/contingent/part-time faculty employed during 2012-2013 academic year
Response: There are no records responsive to this portion of your request.

5. All emails, notes, minutes, memos, reports, spreadsheets, and other documents regarding the institution’s assignment of fall 2013 courses to adjunct/contingent/part-time faculty
Response: This portion of your request is overly broad, and lacks the specificity our office needs to identify and locate the records you seek. In accordance with R.C. 149.43(B)(2), we ask that you revise your request to reflect the manner in which our records are kept. For example, communication records are organized by the creator of the record, not by the subject.
