1. List of part-time faculty, with their full contact information
Response:  See attached report from Sinclair’s Colleague [sic] database listing adjunct faculty employed during Fall 2013. The public records contact information for each adjunct faculty member is the same: Sinclair Community College, 444 West Third Street, Building 15, Dayton, Ohio  45402-1460. Telephone Number:  (937) 512-4400

OPTFA’s Follow-up Response Sent on Dec. 4, 2013: Dear Ms. Ross: We have reviewed the documents you provided in response to our Sept. 26, 2013, public records request and do not find them satisfactory. Specifically, your response to our request: “1. List of part-time faculty, with their full contact information” is incomplete. SCC provides email addresses for its part-time faculty, and those email addresses are public record. Please provide a list that includes them.

2. Lists of adjunct/contingent/part-time faculty employed during 2012-2013 academic year, with title/status, department or program, number of credits taught, and rate of pay
Response:  See attached reports from Sinclair’s Colleague [sic] database listing adjunct faculty employed during Fall 2012, Spring 2013, Summer 2013. The 2012-2013 Adjunct Faculty pay rates were:  Lecturer I: $770.00/payload hour, Lecturer II: $816.00/payload hour

3. Lists of adjunct/contingent/part-time faculty assigned courses for fall semester 2013, with title/status, department or program, number of credits to be taught, and rate of pay
Response:  See attached report from Sinclair’s Colleague [sic] database listing adjunct faculty employed during Fall 2013. The 2013-2014 Adjunct Faculty pay rates are:  Lecturer I: $782.00/payload hour, Lecturer II: $828.00/payload hour

4. Contracts for adjunct/contingent/part-time faculty for fall semester 2013
Response:  Sinclair’s adjunct faculty do not receive contracts; therefore, there are no records responsive to this request.

5. Performance evaluations for all adjunct/contingent/part-time faculty employed during 2012-2013 academic year
Response: Sinclair does not have any records which are responsive to your requests.

6. All emails, notes, minutes, memos, reports, spreadsheets, and other documents regarding the institution’s assignment of fall 2013 courses to adjunct/contingent/part-time faculty
Response:  The request is too broad.   See, e.g. State ex rel. Dehler v. Spatny, 127 Ohio St.3d 312, 2010-Ohio-5711; State ex rel. Zidonis v. Columbus State Community College, 133 Ohio St.3d 122, 2012-Ohio-4228. Sinclair does not file or maintain its records regarding assignment of adjunct faculty in this way.  The assignments are done by each academic department and the procedures used vary among departments.  They also vary depending on the size of the department, the number of course sections to be covered, and the number of full-time faculty in the department.  The records relating to the assignment process also vary depending on who in the department is handling the administrative aspects of the process and how and when the adjunct faculty respond.  If you can narrow your request to a specific department or adjunct faculty member, Sinclair may be able to respond.

7. Budget documents that indicate total budget and total amount and percentage of total budget paid to and allocated for adjunct/contingent/part-time faculty for FY 2003-2004 to FY 2012-2013
Response: Operating budgets for 2008-2009, 2009-2010, 2010-2011, 2011-2012, and 2012-2013 are on Sinclair’s web page at   http://www.sinclair.edu/about/president. I will provide copies of the Operating Budgets for prior years back to 2003-2004 in the near future. Response on Nov. 4, 2013: Please be advised that in these budgets and the ones I previously informed you are posted on Sinclair’s web page, references to part-time faculty are not necessarily limited to adjunct faculty only. In some line items, costs associated with overload or summer pay to full-time faculty members are combined with costs associated with part-time adjunct faculty.

9. Policies, rules, and regulations of the institution, as well as of departments and programs, that govern the hiring, dismissal, assignment, evaluation, promotion, compensation, and benefits of adjunct/contingent/part-time faculty
Response:  A copy of Sinclair’s Adjunct faculty handbook is attached.  (Note, the handbook is labeled 2012-2013, but it is the most recent version and is currently in effect.)  Also attached are copies of the Board of Trustees resolution, and email memo, and supervisor training materials regarding maximum hours of work for adjunct faculty and other part-time employees.

10. Policies, rules, and regulations of the institution, as well as of departments and programs, that govern the support services, office space, and professional development opportunities available to adjunct/contingent/part-time faculty
Response:  A copy of Sinclair’s Adjunct faculty handbook is attached.

11. Policies and procedures regarding payment of unpaid sick time to adjunct/contingent/part-time faculty upon termination of employment.
Response: Sinclair does not have any records which are responsive to your requests.

12. Grievance policies and procedures that apply to adjunct/contingent/part-time faculty

Response: Sinclair does not have any records which are responsive to your requests.

Response: Sinclair does not have any records which are responsive to your requests.

18. All emails, notes, minutes, memos, reports, spreadsheets, and other documents regarding the institution’s disputes/appeals of unemployment compensation claims and Workmen’s Compensation claims for FY 2003-2004 through FY 2012-2013
Response:  The request is too broad.   See, e.g. State ex rel. Dehler v. Spatny, 127 Ohio St.3d 312, 2010-Ohio-5711; State ex rel. Zidonis v. Columbus State Community College, 133 Ohio St.3d 122, 2012-Ohio-4228.  If you can narrow your request, for example, by specifying a shorter time period or by specifying the names of employees, Sinclair may be able to respond.  Be advised that especially with regard to workers’ compensation claims, information in the records may be confidential and subject to redaction.  Please contact me if you want to discuss this request further.

19. Contracts and agreements with law firms that will represent the institution in FY 2013-2014
Response:  Sinclair does not have copies of any such contracts or agreements.  Any such contracts or agreements are between Ohio Attorney General and law firm.  You may contact Ohio Assistant Attorney General Rebecca Albers, Chief of the Education Section to request copies.  Her telephone number is 614-644-7250, and her email address is rebecca.albers@ohioattorneygeneral.gov.

20. Contracts and invoices from law firms that represented the institution from FY 2003-2004 through FY 2012-2013
Response:  With regard to “contracts,” same as response to #19. With regard to invoices, the request is too broad.   See, e.g. State ex rel. Dehler v. Spatny, 127 Ohio St.3d 312, 2010-Ohio-5711, 939 N.E.2d 831; State ex rel. Zidonis v. Columbus State Community College, 133 Ohio St.3d 122, 2012-Ohio-4228.  If you can narrow your request, for example, by specifying a shorter time period, or by identifying law firms or types of work, Sinclair may be able to respond.  Be advised that invoices would contain confidential attorney-client communications, and those entries would be redacted.  Please contact me if you want to discuss this request further.
