University of Akron Response to Sept. 26, 2013, Public Records Request

To whom it may concern:

On September 26, 2013 you submitted a public records request that followed up from your August 27, 2013 request. The University responded to your August 27, 2013 request onUA response to 9/26 September 3, 2013. Please see the responses below:

1. Documents listing the members of part time/adjunct/contingent faculty hiring committees formed by departments/units within the College of Arts and Sciences who hired part-time faculty for fall term 2013, as required by the institution’s “Part- time Faculty Hiring Guidelines.” RESPONSE: The documents are not stored in the manner that you have requested. These documents, if they exist, would be stored by each individual academic unit. If you select a specific program or academic unit I will attempt to locate items from your requests. Second, providing all records for all academic units across campus would essentially amount a complete duplication of University records. See State ex. rei. Glasgow v. Jones, 119 Ohio St.3d 391, 2008-0hio-788. Regardless of the objection I have contacted the two departments within the College of Arts and Sciences that have the most part time faculty to gather any responsive records – Communications and English. There are no responsive documents to your request. While there is a committee and/or involvement from various staff members that will review the hiring of part time faculty, there are no responsive documents.

2. Documents — emails, notes, memos, minutes — related to the within the College of Arts and Sciences Committee Review of Part Time Faculty Application/Acceptance Agreements (PTFAAA) & Selection of Final Candidate(s) for fall term 2013, as required by the institution’s “Part-time Faculty Hiring Guidelines.
RESPONSE: The documents are not stored in the manner that you have requested. These documents, if they exist, would be stored by each individual academic unit. If you select a specific program or academic unit I will attempt to locate items from your requests. Second, providing all records for all academic units across campus would essentially amount a complete duplication of University records. See State ex. rei. Glasgow v. Jones, 119 Ohio St.3d 391, 2008-0hio-788. In addition the request is overly broad. Ohio’s Public Records Act requires that you identify the records you seek with “reasonable clarity” and describe those records “specifically and particularly” (See State ex rei. Glasgow v. Jones, 119 Ohio St. 3d 391 (2008) and State ex rei. Dillery v. Icsman, 92 Ohio State. 3d 312 (2001). . Regardless of the objection I have contacted the two departments within the College of Arts and Sciences that have the most part time faculty to gather any responsive records – Communications and English. Attached are the documents responsive to your request. Please note that the redactions are based on State ex. rei Dispatch Printing Co. v. Johnson, 106 Ohio St.3d 160, 200-0hio-4384.

3. Documents, such as screening checklists or screening matrix, prepared as part of the screening process used by the College of Arts and Sciences hiring committees for part time/adjunct/contingent faculty for fall term 2013, as required by the institution’s “Part-time Faculty Hiring Guidelines.
RESPONSE: The documents are not stored in the manner that you have requested. These documents, if they exist, would be stored by each individual academic unit.
